Repetitive Stress Injuries

Repetitive Stress Injury Lawyer in Decatur

Personal Representation for Gradual-Onset Work Injuries

Repetitive motion and prolonged physical strain can cause disabling conditions without a sudden workplace accident. At The Law Office of Arthur E. Snead, LLC, I, Arthur E. Snead, represent workers in Decatur, Georgia, whose employment caused or worsened carpal tunnel syndrome, tendonitis, back strain, and other cumulative trauma conditions.

My practice is limited entirely to workers’ compensation matters, and you speak directly with me rather than a case manager or intake screener. Before becoming an attorney, I suffered a serious hand injury in a work-related boating accident and navigated the workers’ compensation system myself. That experience informs the direct, personal attention I give every client.

Call (404) 800-1181 to discuss whether repetitive duties or prolonged strain may support a Georgia workers’ compensation claim.

Benefits & Deadlines for Repetitive Stress Injuries

Georgia workers’ compensation generally covers compensable injuries that arise out of and in the course of employment. This means the condition must have a sufficient connection to the job and occur within the employment relationship. Coverage can include occupational diseases and repetitive-use conditions, such as carpal tunnel syndrome, tendonitis, and back strain caused by recurring physical demands.

Reporting and filing requirements depend partly on how Georgia law classifies the condition and determines the injury date. An employee generally must notify the employer of a work accident within 30 days, although limited exceptions can apply when the employer already knows about the injury. Because gradual symptoms can make the applicable date less obvious, report the condition and its suspected work connection promptly.

An occupational disease is caused by hazards associated with a particular occupation rather than an isolated accident. A claim involving an occupational disease generally must be made within one year after the worker knew or should have known about both the disablement and its relationship to employment. The claim is generally barred seven years after the last injurious exposure.

Depending on eligibility and the facts of the claim, available benefits can include:

  • Medical treatment: Authorized care for the compensable condition.
  • Temporary total disability benefits: Income benefits when the injury temporarily prevents the employee from working.
  • Temporary partial disability benefits: Income benefits when the employee returns to lower-paying work because of injury-related restrictions.
  • Permanent partial disability benefits: Compensation based on lasting impairment after the worker reaches maximum medical improvement.
  • Vocational rehabilitation: Assistance that may be available when the employee can’t return to the prior job.

For most non-catastrophic Georgia workers’ compensation claims, income and medical benefits are generally capped at 400 weeks from the legally determined date of injury. Benefit periods and eligibility vary based on the classification of the injury, disability status, and other claim facts.

Proving That Repetitive Work Caused the Condition

A repetitive stress claim needs medical evidence connecting the diagnosed condition to the employee’s duties. Cumulative trauma is physical damage that develops through repeated activity over time. Establishing that connection may require details about how often a task was performed, how long it continued, and when symptoms began affecting work.

Evidence that can document the work connection includes:

  • Medical records identifying the diagnosis, reported symptoms, and treatment history.
  • A clear account of the repetitive motions or prolonged physical demands involved in the job.
  • A symptom history showing when the condition appeared and how it progressed.
  • Work restrictions addressing the duties the employee can’t safely perform.

Pre-Existing Conditions & Work-Related Aggravation

An insurer may attribute symptoms to aging, ordinary wear and tear, or a pre-existing degenerative condition. The central question may be whether employment caused, aggravated, accelerated, or contributed to the diagnosed condition. A pre-existing joint or tendon problem doesn’t automatically prevent an employee from receiving benefits when job duties materially worsened it, but medical evidence and work history remain important.

Dating a Gradual-Onset Condition

A gradual-onset condition may not have one identifiable accident date. Under what’s sometimes called the fictional new accident theory, Georgia may treat the legal date of injury as the point when the condition forced the employee to stop working or seek treatment. That date can affect notice, filing deadlines, and the period used to evaluate benefits, so it must be considered in light of the worker’s medical and employment history.

Representation Through Hearings & Appeals

I can represent you throughout a workers’ compensation case, from shortly after the injury through every level of appeal. I review your reported duties, medical history, work restrictions, and the insurer’s position to identify the disputed issues.

When an insurer delays benefits, disputes causation, or advances an inadequate settlement, I handle the dispute before the Georgia State Board of Workers’ Compensation for employees throughout DeKalb County and across Georgia. If the parties can’t resolve the disagreement, I can request a hearing before the State Board and handle an appeal when further review is necessary.

Communication remains direct throughout the case. I either answer the phone or return the call the same day, so you can discuss developments with the attorney handling your claim.
