Description: The Client was involved in a work-related motor vehicle accident. The Employer accepted the injury to the Client's cervical spine, but denied the injury to the Client's lumbar spine, which prompted the Client to retain counsel. Eventually, through strategic case management, counsel for the Client was able to convince the Employer to accept and provide medical treatment for the Client's lumbar spine. Additionally, counsel for the Client was able to convince the Employer to waive subrogation, so as to allow the Client to pursue a bodily injury claim free from a workers' compensation lien. Ultimately, counsel for the Client was able to settle the workers' compensation claim in favor of the Client.

Outcome: Settlement in the amount of $60,000.00
Description: The Client was working at a warehouse, tripped on construction debris, and fell to the ground, sustaining an injury to the right ankle. The Employer accepted the injury to the Client's right ankle, but delayed in providing medical treatment. To make matters worse, when the Client was released back to work on light-duty restrictions, the Employer cut the Client's hours, and refused to pay the Client temporary partial disability benefits. Given the Employer's shortfalls, the Client retained counsel. Upon entering the case, counsel for the Client was able to initiate and expedite much-needed medical treatment for the Client's right ankle. Additionally, counsel for the Client was able to determine that the Employer owed the Client several thousand dollars in past-due wages, and filed a hearing request in pursuit of the same. Eventually, by continually applying pressure on the Employer, counsel for the Client was able to settle the workers' compensation claim in favor of the Client.

Personal Injury

Outcome: Settlement in the amount of $40,000.00
Description: The Client was involved in motor vehicle accident, which occurred in a gas station parking lot, and sustained an injury to the lumbar spine. The liability carrier classified the injury as "soft tissue" and offered the Client $1,000.00 to settle the bodily injury claim. The Client, however, refused the offer and sought the assistance of counsel. Thereafter, counsel for the Client prepared the case for trial, and, by doing so, was able to settle the bodily injury claim for policy limits of $25,000.00, which then allowed counsel for the Client to pursue an underinsured motorist (UIM) claim for the Client. Ultimately, counsel for the Client was able to settle the UIM claim for an additional $15,000.00, thereby leading to a total settlement value of $40,000.00 for the Client.

Description: The Client was working at a restaurant, slipped on a frozen piece of meat, and fell to the ground, sustaining an injury to the cervical spine. Subsequently, as a result of the fall, the Client acquired bilateral carpal tunnel syndrome (CTS). Not surprisingly, while the Employer accepted the injury to the Client's cervical spine, the Employer denied the bilateral CTS on the ground that it was a pre-existing condition. After retaining the services of a lawyer, however, counsel for the Client filed a hearing request and was able to prove to the Administrative Law Judge (ALJ) that the bilateral CTS was, in fact, traumatically acquired. Not surprisingly, the Employer appealed. Following oral arguments, though, counsel for the Client was able to convince the Appellate Division to affirm the ALJ's Award. Eventually, the Employer was forced to provide medical treatment, including surgery, for the bilateral CTS, after which counsel for the Client was able to settle the workers' compensation claim in favor of the Client.

Description: The Client was involved in a motor vehicle accident and sustained an injury to the cervical spine. Following the accident, the Client acquired counsel, who, after collecting and preserving crucial evidence, and preparing a persuasive demand letter, was able to convince the liability carrier to settle the bodily injury claim for policy limits of $50,000.00, which then allowed counsel for the Client to pursue an underinsured motorist (UIM) claim for the Client. Following mediation, counsel for the Client was able to settle the UIM claim for an additional $65,000.00, totaling a settlement value of $115,000.00 for the Client.

Description: The Client was working at a grocery store and fell through a pallet, sustaining an injury to the right foot. However, after accepting the injury to the Client's right foot, the Employer not only refused to acknowledge that said injury had evolved into complex regional pain syndrome (CRPS), but also delayed in providing necessary medical treatment, thereby forcing the Client to seek counsel. Counsel for the Client, in turn, carefully managed the Client's care, and had the Client seen by multiple specialists, all of whom agreed that the Client was, in fact, suffering from CRPS. Additionally, counsel for the Client had the Client consult with a prosthetist, who projected significant medical expenses in the event that a below-the-knee amputation was necessary to address the CRPS. With the informational leverage gained from the specialists, as well as the prosthetist, counsel for the Client was able to settle the workers' compensation claim in favor of the Client.

Description: The Client sustained an injury to the cervical spine after slipping and falling in the back of a company work-truck. The Employer, however, adamantly denied the workers' compensation claim, arguing that the accident never happened, and that the Client was suffering from a pre-existing condition. In response, the Client retained counsel, who prepared the case for a hearing. Notably, even though there were no witnesses to the accident, counsel for the Client was able to mediate and successfully settle the workers' compensation claim in favor of the Client.
